StartOptions Terms of Service

StartOptions provides a provides a fully customized, secure and modular open standards platform which enables online traders to speculate easily on movements within the financial markets, including stocks, indices, commodities and currencies (the “Platform“), through the StartOptions website located at (the “Site“). For purposes of these Terms of Service (the “Terms”), “StartOptions” shall include StartOptions Holdings, Ltd., and its divisions, subsidiaries, successors, parent companies, and their employees, partners, principals, agents and representatives, and any third-party providers or sources of information or data, as well as StartOptions wiki, StartOptions Blog, StartOptions Above/Below.

Please read the Terms carefully. These Terms govern your access to and use of the Site and the Platform, including any games, applications, services, products, information or data made available through the Platform or the Site (collectively, “Services”). This is a legal agreement between you and StartOptions. YOU UNDERSTAND THAT BY CHECKING THE “I have read and accept the Terms of Use” CHECKBOX, OR BY USING THE SITE (INCLUDING ANY CONTENT OR SERVICE PROVIDED THEREIN), OR YOUR ACCOUNT, YOU ARE AGREEING TO BE BOUND BY THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS IN THEIR ENTIRETY, YOU MAY NOT ACCESS OR USE THE SITE.

By accessing the Site or using the Services, you agree to be bound by these Terms, whether you are a “Visitor” (which means that you are only browsing the Site) or you are a “Member” (which means that you have registered with the Site). The term “User” refers to a Visitor or a Member. Your use of the Platform, the Site and any Service, as well as any account you may have with StartOptions, is subject at all times to the StartOptions Terms (whether as a Visitor or a Member, regardless of whether your access or use is intended). Issues concerning collection and use of information by StartOptions are described in StartOptions Privacy Policy. The StartOptions Site and Platform are always evolving, so it is important that you periodically check here, as well as the specific rules for any Services in which you choose to participate, for updates. If we revise the Terms, such revision will take effect immediately upon being posted on the Site. By using the Platform, accessing the Site, or taking part in any Services, you agree to review the Terms periodically to become aware of such revisions. If you do not agree to any of the Terms stated herein, you should discontinue using the Platform and the Site or participating in any Services. StartOptions reserves the right, in its sole discretion, at any time to modify, discontinue or terminate the Site, the Platform and any Services without notice.

Use of the Services and access to the Site is void where prohibited. By using the Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 18 years of age or older or else, have your parent’s or guardian’s permission to enter into this Agreement, or otherwise have the ability to form a binding contract; and (d) your use of the Services does not violate any applicable law or regulation or any obligation you may have to a third party.

Account Registration

When you complete the registration process, you create a StartOptions account and become a Member. Your account allows you to participate in certain Services, subject to the Terms and the StartOptions Privacy Policy. To create an account, you must select a username and password. Your username is your StartOptions identity. You may not select a username that is used by someone else, and your username cannot be indecent, or otherwise offensive, or be used in any way that violates the Terms and common practices. You may not provide false information during the registration process. You must provide truthful and accurate information while creating your StartOptions account.
StartOptions reserves the right to limit the number of accounts a user can establish on the sites. This limit may change over time at StartOptions’ discretion.

You are solely responsible for all activity on your account and the security of your computer system or video console system. You should not reveal your password to other users. StartOptions will not ask you to reveal your password. If you forget your password, you can request to have a new password sent to your registered e-mail address. You agree to indemnify and hold StartOptions harmless for any improper or illegal use of your account. This includes illegal or improper use by someone to whom you have given permission to use your account. Your account is at risk if you let someone use it inappropriately and your account in any of StartOptions services is subject to termination if you or anyone using your account violates StartOptions Terms. If your account is terminated, you may not join StartOptions again without its express permission.

Binary Options

StartOptions offers Users the opportunity to purchase binary options through the Site (“Binary Options”). Methods for the calculation of all data regarding Binary Options (including payouts, value, expiration and rates) are set forth at http://startoptions.StartOptions.com/options/asset-index/ (the “Asset Index Page”) . Such methods of calculation may change from time to time at StartOptions’ sole discretion. As such, Users should refer to the Asset Index Page regarding the method of calculation applicable to any specific Binary Option prior to the purchase of such Binary Option.

All financial information posted on the Site, including any information regarding pricing, exchange rates, stocks, indices and commodities may be inaccurate. Company does not undertake to update any such information or data in real time and, as such, such information or data may be erroneous and may not reflect current market conditions. Company bears no responsibility for losses (whether to a User or to any third party) as a result of any reliance by a User on any information (whether financial or otherwise) posted on or implied by other information or data posted on the Site. Company may remove any data posted on the Site at any time and with no advance notice. Any chart or graph appearing on the Site or through the Services is provided for informational purposes only. No investment decisions should be based on such charts or graphs.

The price of any Binary Option appearing on the Site is a price quoted by StartOptions at a specific time and date. Such price may not be available at any other time. StartOptions reserves the right to cease selling any Binary Option at any time without notice. StartOptions reserves to right to change the terms of any Binary Option available on the Site at any time without notice.

Financial Risks of Binary Options

Use of the Services, and especially the purchase of Binary Options through the Site, is speculative and may involve extraordinarily high financial risk to a User. Binary Options should only be purchased through the Site by sophisticated Users capable of bearing the loss of all amounts used to purchase Binary Options. By using the Site, each User expressly acknowledges such risks, and affirms that it is capable of bearing such risks. Each User confirms that it understands that market fluctuations may occur over short time periods, and that this may result in very different payouts of any Binary Options purchased through the Site. No existing method can assure the User of profit through trading in Binary Options. User expressly acknowledges and agrees:

(1)   User has full and independent knowledge and understanding of the risks involved in the purchase of Binary Options.

(2)   All such purchases of Binary Options are at the sole discretion of the User

(3)   Purchase of Binary Options may result in significant financial losses to the User.

(4)   User is aware that the term of a Binary Option may be extremely short, and the value of any Binary Option may be subject to extreme fluctuations in value over such period; and

(5)   User has read and understood the StartOptions Terms of Service and these Account Terms and Conditions.

Users are urged to consult with advisors concerning the financial, legal and tax implications of the purchase of Binary Options.

Use of Site at Users’ Risk

User bears sole responsibility for any decision to purchase Binary Options through the Site or the Platform. StartOptions reserves the right to cancel any trades, purchases or other actions of any User, or cancel such Users account without refund, all at its sole discretion, if StartOptions believes in its sole discretion that such User is engaging in unethical, illegal or unlawful activity, or in any activity which may cause damage to StartOptions or the Site. User is bound to by the terms and conditions of any order, purchase or trade made through the Site or the Platform. StartOptions cannot accept any requests to modify or cancel any orders received from User.  User will not assume that a specific order was executed unless User receives an official report from StartOptions which approves the execution of such order. It is User’s responsibility to verify the status of the pending orders, as well as any deposits, withdrawals and payments in connection with its account or any trade or purchase.

Each User must ensure that Services received through the Site are used only in accordance with applicable law and that the purchase or trade of Binary Options does not violate the law of any jurisdiction to which such User is subject.  The User confirms and agrees that StartOptions might impose restrictions on trade, payments, Services or any other restriction on the account if required to by law or court order. User agrees that StartOptions might be required to set off or block amounts of money in User’s account to satisfy requirements of law or government authorities and User shall have no right, claim or demand from StartOptions in respect such losses.

User is responsible for reading any order confirmations and account reports delivered by to User by StartOptions, whether by email, regular mail or in any other form, immediately following receipt by the User. Company shall consider the reports accurate unless the User objected within three (3) business days.

Each user is responsible for ensuring that its means of access to its account are secure, including any Usernames and Passwords obtained upon registration with the Site.

Intellectual Property & Content

StartOptions owns the Site and the Platform, including all worldwide intellectual property rights in the Site, Platform and Services, and the trademarks, service marks, and logos contained therein.  StartOptions hereby grants you a limited, revocable, nonsublicensable license to use the Services solely for your personal use. Except as expressly permitted herein, you may not copy, further develop, reproduce, republish, modify, alter download, post, broadcast, transmit or otherwise use the Services.  You will not remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in the Site, Platform Content or Services.

Certain types of content may be made available through the Site. “Content” as used in these Terms means, collectively, all content on or made available through the Site and the Platform, including but not limited to text, data, reports, analyses, performance charts, investment portfolios, and stock quotes. StartOptions reserves the rights to remove and permanently delete any Content from the Site without notice.

Violation

If you violate the StartOptions Terms, StartOptions may issue you a warning regarding the violation, or, in its sole discretion, it may may terminate or suspend your access to the Site or any portion thereof and remove any material from the Site at any time for any reason without notice to you. Further, if StartOptions believes, in its sole discretion, that a violation of these Terms has occurred, we may take any other corrective action we deem appropriate. We reserve the right to investigate suspected violations of these Terms. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone believed to violate these Terms. You may request termination of your StartOptions account at any time and for any reason by sending an email to admin@startoptions.com. Any suspension, termination, or cancellation shall not affect your obligations to StartOptions under these Terms (including but not limited to ownership, indemnification, and limitation of liability), which by their sense and context are intended to survive such suspension, termination, or cancellation.

Disclaimers & Disclaimer of Warranty

Your use of the Site, Content and Services is at your sole discretion and risk. StartOptions does not guarantee that the trading or purchase of Binary Options on the Site will be continuous or uninterrupted, or that the Platform will operate in a safe and error free manner.  Malfunctions in the Platform or failures in hardware, software, communication lines may cause interruptions in the Service. Data, graphs, charts and other information on the Site may be supplied by third parties unrelated to StartOptions, and StartOptions cannot guarantee that such third parties shall continue to supply such data, graphs, charts or information, or that such data, graphs, charts and information is correct, accurate or up-to-date.

The Site, Platform, Content and Services are provided on an AS IS and AS AVAILABLE basis without warranties of any kind from StartOptions. STARTOPTIONS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, RELATING TO THE SITE, PLATFORM, CONTENT, AND SERVICES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF PROPRIETARY RIGHTS, COURSE OF DEALING OR COURSE OF PERFORMANCE. STARTOPTIONS DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED,: (I) REGARDING THE SECURITY, ACCURACY, RELIABILITY, TIMELINESS AND PERFORMANCE OF THE SITE, CONTENT, PLATFORM, AND SERVICES; OR (II) THAT THE SITE, PLATFORM AND SERVICES WILL BE ERROR-FREE OR THAT ANY ERRORS WILL BE CORRECTED; OR (III) REGARDING THE PERFORMANCE OF OR ACCURACY, QUALITY, CURRENCY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION PROVIDED BY THE SITE, PLATFORM AND SERVICES. StartOptions is not responsible for any incorrect or inaccurate Content posted on the Site or in connection with the Services, whether caused by Users of the Services or by any of the equipment or programming associated with or utilized in the Services. StartOptions takes no responsibility for third party advertisements which are posted on this Site or through the Services, nor does it take any responsibility for the goods or services provided by its advertisers. No advice or information, whether oral or written, obtained by you from StartOptions, shall create any warranty not expressly stated in these Terms. Any chart or graph appearing on the Site or through the Services is provided for informational purposes only. No investment decisions should be based on such charts or graphs. If you choose to rely on such information, you do so solely at your own risk. Some states or jurisdictions do not allow the exclusion of certain warranties. Accordingly, some of the above exclusions may not apply to you.

Limitation of Liability

StartOptions assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any Content or Services. StartOptions is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email due to technical problems or traffic congestion on the Internet or on any of the Site or Services or combination thereof, including any injury or damage to Users or to any person’s computer related to or resulting from participation or downloading materials in connection with the Site or Services. Under no circumstances shall StartOptions be responsible for any loss or damage, including personal injury or death, resulting from use of the Site or Services, from any Content posted on or through the Site or Services, or from the conduct of any Users of the Site or Services, whether online or offline. The purchase or trading of Binary Options may be stopped at any time by StartOptions without notice, and StartOptions shall not bear any liability for such stoppages in trading or purchase of Binary Options.

IN NO EVENT SHALL STARTOPTIONS OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, CONTENT, PLATFORM AND SERVICES, INCLUDING BUT NOT LIMITED TO THE QUALITY, ACCURACY, OR UTILITY OF THE INFORMATION PROVIDED AS PART OF OR THROUGH THE SITE OR FOR ANY INVESTMENT DECISIONS MADE ON THE BASIS OF SUCH INFORMATION, WHETHER THE DAMAGES ARE FORESEEABLE AND WHETHER OR NOT STARTOPTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION AND IN NO EVENT SHALL STARTOPTIONS’S CUMULATIVE LIABILITY TO YOU EXCEED AMOUNTS PAID TO PURCHASE A BINARY OPTION.

The Site, Services or Content may provide links to third-party websites or resources. You acknowledge and agree that StartOptions is not responsible or liable for the availability or accuracy of such websites or resources or the content, products, or services on or available from such websites or resources. You further acknowledge that StartOptions does not endorse such websites or resources or the content, products, or services on or available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

Restrictions

You agree you will not do any of the following while using or accessing the Site or any content thereon:

1. Use the Site, Content, Platform or Services in connection with any commercial endeavors in any manner, except for the purposes specifically set forth in these Terms.
2. Circumvent, disable, or otherwise interfere with security-related features of the Site or features that prevent or restrict use or copying of any Content
3. Interfere with or disrupt (or attempt to interfere with or disrupt) any web page available at the Site, servers, or networks connected to the Site, or the technical delivery systems of StartOptions’ providers, or disobey any requirements, procedures, policies, or regulations of networks connected to the Site
4. Attempt to probe, scan, or test the vulnerability of any StartOptions system or network or breach or impair or circumvent any security or authentication measures protecting the Site;
5. Attempt to decipher, decompile, disassemble, or reverse-engineer any of the software used to provide the Site;
6. Attempt to access, search, or meta-search the Site or content thereon with any engine, software, tool, agent, device, or mechanism other than software and/or search agents provided by StartOptions or other generally available third-party web browsers, including without limitation any software that sends queries to the Site to determine how a website or web page ranks
7. Violate the Terms or any other rule or agreement applicable to you or StartOptions through the Site’s inclusion in, reference to, or relationship with any third party or third-party site or service, or your use of any such third-party site or service
8. Use, launch, or permit to be used any automated system, including without limitation “robots,” “crawlers,” or “spiders”; or
9. Use the Site or content thereon in any manner not permitted by this Agreement.

Indemnification

You agree to defend and indemnify StartOptions and its officers, directors, employees, and agents and to hold them harmless from and against any and all claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney’s fees and costs, arising out of or in any way connected with (i) your access to or use of the Site, Platform, or Services; or (ii) your violation of any of these Terms.

Deposits and Withdrawals

User shall be responsible for complying with all applicable laws and regulations regarding money laundering. StartOptions reserves the right to request from any User all information required in order to comply with such laws and regulations. The failure by a User to provide such correct identifying information may result in the rejection of any request, purchase or trade by StartOptions, and the closing of any account of such User and any other action deemed by StartOptions in its sole discretion to be necessary to comply with applicable law and regulations.

StartOptions will pay Users profits only to the account that was used when a deposit was made, and following User’s withdrawal order instructions. Any withdrawal from any account of any User by bank transfer will be transferred solely to the bank account the deposit was originally received from. StartOptions will make reasonable commercial efforts to pay the Users in accordance with the instructions of such User. Notwithstanding the above, StartOptions reserves the right to pay Users through any means in accordance with the requirements of applicable law, regulation, or the internal procedures of StartOptions and any credit card or bank of the User.

The failure by a User to provide correct bank or other account information may result in a rejection of any request, the transfer to a wrong account or the cancellation of the deposit order.

If and to the extent StartOptions shall allow payments or deposits by means other than credit cards or bank transfers, User hereby agrees to comply with all law, regulations and rules applying to such services. StartOptions, at its sole discretion, might carry out withdrawal orders by means other than those specified in an original deposit order, subject to its own interpretation of laws and regulations.

Bonuses and Special Offers

StartOptions in its sole discretion may offer special offers and bonuses (a “Special Offer”) to any, some or all Users. StartOptions shall publicize the terms of all such Special Offers at the time these are offered to Users, and Users who agree to take advantage of such Special Offers must comply with all terms and conditions thereof. Abuse of any Special Offer or failure to comply with the terms and conditions thereof may lead to, at the sole discretion of StartOptions, cancellation of the Special Offer and closure of the User’s account. StartOptions reserves the right to cancel, revoke or change such offers at any time without prior notice.

Unless stated otherwise in the terms of any Special Offer, the grant of any amount pursuant to any Special Offer is conditioned on a User making purchases or trades through the Site in an amount equal to at least 10 times such granted amount. Abuse of any Special Offer may lead to cancellation of such Special Offer and closure of the User’s account. All Special Offers must be used within the period set forth in the terms and conditions of such Special Offer. Should the any Special Offer fail to be used within this time frame, the amount granted pursuant to such Special Offer will be withdrawn from the User’s account. StartOptions reserves the right to revoke any Special Offer should it be abused or should a User fail to meet the terms of such Special Offer. Any such decision shall be at StartOptions sole discretion and shall be final. The Company reserves the right to revoke or change Special Offers at any time without prior notice.

General

In the event that any provision in these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure of a party to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. StartOptions may assign this agreement or any rights hereunder without your consent. These Terms shall be governed by and interpreted in accordance with the laws of Cyprus excluding that body of law pertaining to conflict of laws. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in Limassol, Cyprus, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein. You agree that these Terms and the rules, restrictions, and policies contained herein, and StartOptions enforcement thereof, are not intended to confer and do not confer any rights or remedies on any person other than you and StartOptions. StartOptions may amend these Account Terms and Conditions from time to time. User is responsible for checking whether these Account Terms and Conditions were amended. Any amendment shall come into force as of the day it was published on the Site. StartOptions is entitled to assign its rights and/or liabilities by a notice to the User. User has no right to assign his rights and/or his liabilities unless a prior written consent to that effect was given by StartOptions at its sole discretion.
